General information

"TagMachine", "We", "Us", "The Company", "Our" and "Us" refer to LAVAL ASESORES FINACIEROS SL, as well as our affiliates, directors, subsidiaries, contractors, licensees, officers, agents and employees.
By using TagMachine, you agree to the following Terms of Service, including the Privacy Policy and Cookie Policy.

You agree that by installing, logging in, downloading or using TagMachine, you enter into a binding agreement between you and TagMachine on the Terms of Service. You confirm that you have read, understood and agree to these Terms of Service. If you do not agree to the Terms of Service, please do not use TagMachine.
You represent and warrant that you are at least 14 years old and have the legal capacity to enter into this agreement. If you are under 18, be sure to read these Terms of Service with your parent or legal guardian and ask any questions you may have.
When you use or create an account on behalf of a Company, Entity or Organization, you warrant that you are an authorized representative of such Subscribing Organization and have the authority to bind it to these Terms of Service and grant the rights set forth in these Terms of Service; and you agree to the Terms of Service on behalf of such Subscribing Organization.

2. Payment

The Tagmachine service is initially offered free of charge. The company reserves the right to change the payment terms in the future. In particular, it may choose to charge for the use of the extension or for the provision of new features or services.

3. Prohibited Conduct

In addition to activities that are contrary to acceptable use, use of the site, the Chrome extension or its content is prohibited:

  • for any illegal purpose
  • requesting others to perform or participate in illegal acts
  • violate any local, international, federal, provincial or state regulation, rule, law or ordinance
  • infringe or violate our intellectual property rights or those of third parties
  • harass, abuse, insult, harm, defame, libel, slander, disparage, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability.
  • presenting false or misleading information
  • upload or transmit viruses or any other type of malicious code that is or may be used in any way that could compromise the function or operation of the Service or any related website, other sites or the Internet
  • to collect or track personal information from others
  • generate spam, phishing, pharm, pretext, spider, crawl, trace or scrape
  • for any obscene or immoral purpose
  • interfere with or circumvent the security features of the Service or any related website or the Internet.

4. Intellectual Property

All trademarks, service marks, product names and trade names of the Company appearing on or through the service or product are the exclusive property of TagMachine. All other trademarks, service marks, product names, copyrights and logos appearing on or through the service or product are the property of their respective owners. You may not use or display any trademark, service mark, product name, trade name or logo appearing on or through the Service without the prior written consent of the owner. TagMachine is the exclusive owner of the product and any software components or technology incorporated therein. Except as explicitly stated herein, nothing in this Agreement shall be construed as conferring any license to any intellectual property rights, whether by estoppel, implication or otherwise. All content included in the product and service is the property of the Company or its respective licensors or content providers and is protected by Spanish and international copyright laws.

5. Exclusion of warranties

TagMachine provides the Website and the Service on an "as is" and "as available" basis, without warranty of any kind. Without limiting the foregoing, we expressly disclaim all warranties, whether express, implied or statutory, relating to the Service, including, without limitation, any warranties of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement.

TagMachine does not warrant that the Service will meet your requirements; that the Service will be uninterrupted, timely, secure or error-free; that the information provided through the Service will be accurate, reliable or correct; that any defects or errors will be corrected; that the Service will be available at any time or location; or that the Service is free of viruses or other harmful components. You assume all responsibility and risk of loss arising from the download or use of files, information, content or other material obtained from the Service.

6. Limitation of liability

You understand and agree that we shall not be liable to you or any third party for any loss of profits, use, goodwill or data, or for any incidental, indirect, special, consequential or exemplary damages, however arising, resulting from:

  • your use or inability to use the Service;
  • any modification, price change, suspension or discontinuation of the Service;
  • the Service generally or the software or systems that make the Service available;
  • unauthorized access to or alteration of your transmissions or data;
  • statements or conduct of third parties in the Service;
  • any other user interaction you enter or receive through your use of the Service; or
  • any other matter related to the Service.

Our liability is limited, regardless of whether we have been advised of the possibility of such damages, and even if it is determined that a remedy set forth in this agreement has failed of its essential purpose. We will not be liable for any failure or delay due to causes beyond our reasonable control.

You agree to indemnify, defend and hold us harmless from and against any and all claims, liabilities and expenses, including attorneys' fees, arising out of your use of the Website and the Service, including, without limitation, your violation of this Agreement, provided that TagMachine gives you prompt written notice of the claim, demand, suit or proceeding; gives you exclusive control of the defense and settlement of the claim, suit, suit or proceeding (provided that you may not settle any claim, suit, suit or proceeding unless the agreement unconditionally releases TagMachine from all liability); and provides you with all reasonable assistance, at your expense.

8. Upgrades and improvements

To improve and develop TagMachine, we may automatically download and install updates and upgrades periodically. These updates and upgrades are designed solely to improve the service, provide enhanced functionality or integrate new modules and releases that will not affect your device in any way. You hereby agree to receive such updates and upgrades as part of your use of TagMachine. If we believe that such updates or upgrades will significantly affect your use of TagMachine, we will use our best efforts to notify you.

9. Additional Information

These Terms of Service shall be governed by the laws of Spain. If you do not have jurisdiction in Spain or any other EU Member State, if you have moved your permanent address abroad after the entry into force of these Terms of Service, or if your domicile or usual place of residence is unknown at the time legal action is commenced, the sole jurisdiction for all disputes arising under this agreement shall be our registered office.
We reserve the right to modify and adapt these Terms of Service with future effect. You will be notified at the latest one month prior to the entry into force of the new Terms of Service. If you do not object to the validity of the new Terms of Service within one month of their entry into force, you will be deemed to have accepted them. We will inform you separately and adequately about the importance of the one-month notice period, your right to object and the legal consequences of not doing so.

By using TagMachine, you agree to the following Privacy Policy, including the Terms of Service and Cookie Policy.

This privacy policy ("Privacy Policy") explains how TagMachine ("TagMachine" or "we" or "us") collects and processes information from members and users of the application.

If we ever need additional personal information for any specific reason, we will let you know and ask for your permission. In addition, if TagMachine links to other websites, please note that we do not own, operate or control those sites and that those sites have their own privacy policies which we encourage you to review.

1. Minors

IF YOU ARE UNDER 14 YEARS OF AGE, DO NOT USE OR ACCESS TAGMACHINE SERVICES AT ANY TIME OR IN ANY MANNER.
Protecting the privacy of young children is especially important. Therefore, TagMachine does not knowingly collect or maintain personal information from children under the age of 14. If TagMachine discovers that personal information has been collected from children under the age of 14 on or through the TagMachine Services, TagMachine will take steps to delete it.

If you are the parent or legal guardian of a child under the age of 14 who has become a member of the TagMachine Services, please contact TagMachine at developer@tagmachine.me to cancel that child's account and delete his or her personal information.

To offer our products, TagMachine collects information that you share directly with us by using our extension. Your email allows you to create an account that will allow you to create your tags and all the websites you advertise on your account.

TagMachine also collects technical information about your device and its use to ensure the proper functioning of our products. This collected information is intended to provide TagMachine members with a better way to create their tags and to help us develop, improve and market our services.

4. Account and profile information

When you register with TagMachine, you share certain information during the registration process, including your name, email, password and other information to personalize your profile. You can also register with your PayPal account, which allows TagMachine to view your basic profile information, such as your name and email address.

TagMachine may automatically collect information to ensure proper operation on different devices and browsers.

This data allows us to make sure TagMachine is working properly, improve your experience, and detect and prevent fraud.
TagMachine does not track your search engine history, your emails or your browsing, only the website added to a tag.

If you wish to stop using TagMachine, we have instructions on how to uninstall the extension on our website and, if you have any problems, you can contact our support team for help by sending an email to developer@tagmachine.me.

If you wish to delete your profile or personal information, you may request to do so by sending an email to the same address. We will delete any personal information we have, although we may still store some data in an aggregated, anonymous format that does not identify or attribute you (or if we are required to do so by law).
