TERM OF SERVICE
1. General Information
“TagMachine”, “We”, “The Company”, “Our”, and “Us” refer to LAVAL ASESORES FINACIEROS S.L., as well as our affiliates, directors, subsidiaries, contractors, licensors, officers, agents, and employees.
By using TagMachine you agree the following Terms of Service, including the Privacy Policy and Cookie Policy.
You accept that when you install, log in, download or use TagMachine you are celebrating a binding agreement between you and TagMachine about the Terms of Service. You confirm that you have read and understood these Terms of Service and accepted it. If you disagree with the Terms of Service, please do not use TagMachine.
You represent and warrant that you are at least 14 years of age and of legal competence to enter into this agreement. If you are under 18, please be sure to read this Terms of Service with your parents or legal guardians and ask questions about things you do not understand.
When you use or create an account on behalf of a Company, Entity or Organization, you guarantee that you are an authorized representative of said Subscriber Organization and have the authority to subject it to these Terms of Service and to grant the rights set forth therein; and you accept the Terms of Service on behalf of that Subscribing Organization.
2. Payment
Tagmachine service is initially provided for free. The company reserves the right to change the payment terms in the future. Specifically, the company could determine to start charging for the use of the extension or for the provision of new features or services.
3. Prohibited Conduct
In addition to activities that go against acceptable use, the use of the site, the chrome extension or its content is prohibited:
• for any illegal purpose
• to ask others to carry out or participate in illegal acts
• to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
• to infringe or violate our or third parties' intellectual property rights
• to harass, abuse, insult, harm, defame, slander, discredit, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability
• to present false or misleading information
• to upload or transmit viruses or any other type of malicious code that is or may be used in any way that may compromise the function or operation of the Service or any related website, other sites or the Internet
• to collect or track personal information of others
• to generate spam, phish, pharm, pretext, spider, crawl or scrape
• for any obscene or immoral purpose
• to interfere with or circumvent the security features of the Service or any website related to other sites or the Internet.
4. Intellectual Property
All trademarks, service marks, product names, and trade names of the Company appearing on or through the service or the product are exclusively owned by TagMachine. All other trademarks, service marks, product names, copyrights and logos appearing on or through the service or product are the property of their respective owners. You may not use or display any trademark, service mark, product name, trade name, or logo appearing on or through the Service without the owner’s prior written consent. TagMachine is the exclusive owner of the product and any software component or technology incorporated therein. Unless explicitly stated herein, nothing in this agreement shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication, or otherwise. All content included in the product and the service is the property of the Company or its respective licensors or content suppliers and is protected by Spanish and international copyrights laws.
5. Disclaimer of Warranty
TagMachine provides the website and the service “as is” and “as available,” without warranty of any kind. Without limiting this, we expressly disclaim all warranties, whether express, implied or statutory, regarding the Service including without limitation any warranty of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement.
TagMachine does not warrant that the Service will meet your requirements; that the Service will be uninterrupted, timely, secure, or error-free; that the information provided through the Service is accurate, reliable or correct; that any defects or errors will be corrected; that the Service will be available at any particular time or location; or that the Service is free of viruses or other harmful components. You assume full responsibility and risk of loss resulting from your downloading and/or use of files, information, content or other material obtained from the Service.
6. Limitation of liability
You understand and agree that we will not be liable to you or any third-party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential or exemplary damages, however arising, that result from:
• your use or inability to use the Service;
• any modification, price change, suspension or discontinuance of the Service;
• the Service generally or the software or systems that make the Service available;
• unauthorized access to or alterations of your transmissions or data;
• statements or conduct of any third party on the Service;

7. Release and Indemnification
You agree to indemnify us, defend us, and hold us harmless from and against any and all claims, liabilities, and expenses, including attorneys’ fees, arising out of your use of the Website and the Service, including but not limited to your violation of this agreement, provided that TagMachine promptly gives you written notice of the claim, demand, suit or proceeding; gives you sole control of the defense and settlement of the claim, demand, suit or proceeding (provided that you may not settle any claim, demand, suit or proceeding unless the settlement unconditionally releases TagMachine of all liability); and provides to you all reasonable assistance, at your expense.
8. Updates and Upgrades
In order to enhance and further develop of TagMachine we may automatically download and install updates and upgrades from time to time. These updates and upgrades are designed solely to improve the service, provide enhanced functionalities, and/or embed new modules and versions which will not affect your device in any way. You hereby agree to receive such updates and upgrades as part of your use of TagMachine. In the event we believe that such updates or upgrades shall materially affect your use of TagMachine, we will make best efforts to notify you.
9. Additional information
This Terms of Service shall be governed by the laws of Spain. If you have no place of jurisdiction in Spain or in any other EU member state, if you have transferred your permanent domicile abroad after these Terms of Service take effect or if your domicile or usual place of residence is unknown at the time legal action is taken, the sole place of jurisdiction for all disputes arising from this agreement will be the location of our registered office.
We reserve the right to amend and adapt these Terms of Service with effect for the future. You will be notified no later than one month before new Terms of Service take effect. If you do not object to the validity of the new Terms of Service within one month after they take effect, you will be deemed to have accepted the new Terms of Service. We will inform you separately in suitable form about the significance of the one month’s notice period, your right to object and the legal consequences of non-objection.

By using TagMachine you agree the following Privacy Policy, including the Terms of Service and Cookie Policy.
This privacy policy (“Privacy Policy”) explains how TagMachine (“TagMachine” or “we”) collects and processes information from members and users of the application.
If we ever need additional personal information for a specific reason, we will tell you and ask for your permission. Also, to the extent that TagMachine has links to other websites, please note that we do not own, operate, or control them, and they have their own controlling privacy policies that you should review.
1. Minors
IF YOU ARE UNDER 14 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE TAGMACHINE SERVICES AT ANY TIME OR IN ANY MANNER.
Protecting the privacy of young children is especially important. For that reason, TagMachine does not knowingly collect or maintain personal information from persons under 14 years-of-age. If TagMachine learns that personal information of persons under 14 has been collected on or through the TagMachine Services, the Company will take appropriate steps to delete this information.
If you are the parent or legal guardian of a child under 14 who has become a TagMachine Services member, then please contact TagMachine at developer@tagmachine.me to have that child’s account terminated and personal information deleted.

3. What data we collect and why
In order to provide our products, TagMachine collects information that you share directly with us when you use our extension. Your email to set up an account which let you start making your tags and all the websites that you ad at your account.
TagMachine also collects technical information about your device and use of TagMachine to make sure that our products are working correctly. The information we collect is geared to providing TagMachine members a better way to create their tags and to help us develop, improve, and market our services.
4. Account and Profile Information
When you become a member of TagMachine, you share a limited amount of information during the registration process, including your name, email address, member password and other registration information to personalize your profile. You can also sign up using your existing PayPal account, which lets TagMachine see basic profile information you provided to PayPal, like your name and email address.
5. Technical Information
TagMachine automatically could collect information to ensure that works correctly on different devices and browsers. This includes data like
• the type of device you are using
• the device’s unique ID (where available)
• operating system
• browser type
• IP address
• error logs
This data allows us to make sure TagMachine is working correctly, to make your experience better, and to detect and prevent fraud.
TagMachine does not track your search engine history, emails, nor your browsing, only the website added to one tag.

If you would like to delete your profile or personal information, you can always ask us by emailing developer@tagmachine.me. We will delete any personal information we have, though we may still store some data in an aggregated and anonymized format that does not identify you and cannot be attributed to you (or if we’re legally required).

You will typically not be charged any fee for effecting these rights, but TagMachine reserves the right to charge a reasonable fee (or refuse to comply) if the request is unfounded, repetitive, or excessive.

We will confirm receipt of your request within 10 days, and will provide a response to you within 45 days of your request, though in some exceptional cases it might take longer (if that happens, we will let you know). We will need your name and email address to verify your request, and may also ask for additional information if necessary to verify the identity of the person making the request. We reserve the right to deny your request if we cannot verify your identity, or if an exemption applies. That said, we will not discriminate against you for exercising any of your privacy rights.

TagMachine may use third-party Web analytics services in connection with TagMachine Services.
